Privacy Policy

This Privacy Policy describes how Photogenik Inc. (“Photogenik,” “we,” “us,” or “our”) collects, uses, and discloses information in connection with the Photogenik mobile application (the “App”). By using the App, you agree to the practices described in this policy. If you do not agree, do not use the App.

Face and depth sensing are performed on your device. The “Find Your Angles” feature analyzes your face using your device’s on-device camera and depth technology, and our live framing guidance (“GuideMe” and “PoseMe”) reads on-device depth to gauge distances in the scene, such as how far you are from a wall or the position of the floor. The camera feed, your facial geometry, and all depth data are processed locally and in real time. They are not uploaded to our servers, stored by us, used to identify you, or shared with third parties. Best Shots is separate: only after you expressly allow AI analysis, smaller copies of the photos you select are sent to Google Gemini as described in Section 4.1.

1. Who we are

The App is published by Photogenik Inc. This policy applies to information processed through the App and our related services. It does not apply to third-party services that have their own privacy policies, which are referenced below.

We do not collect your location, contacts, health data, or advertising identifiers (IDFA). We do not use third-party advertising networks and do not track you across other companies’ apps or websites.

3. Information that stays on your device

A substantial part of the App runs entirely on your device. The following are stored locally and are not transmitted to us:

Your angle profile (the scores and recommendations) is the only scan-related information that syncs to your account, and it does not include images.

4. Camera and photos

The App requests access to your camera and photo library solely to provide its features:

4.1 Best Shots AI analysis

Best Shots uses Google Gemini, provided through Google Vertex AI on Photogenik’s Google Cloud service, to compare and rank a group of photos you select. Before the first analysis, the App identifies Google Gemini, explains what will be sent, and asks for your express permission. Declining does not upload photos or charge a Best Shots credit. You can revoke permission later in Profile under Privacy & Data; revocation prevents future Best Shots uploads unless you give permission again.

If you consent, Photogenik sends smaller copies of only the photos you selected, together with limited technical ranking metadata and a pseudonymous authenticated request identifier. Your original files and the rest of your photo library are not sent. Photogenik erases its uploaded-image buffers when the request finishes and may retain a photo-free ranking result for up to 15 minutes to safely complete or retry the request without charging twice.

Google processes the selected photo copies under its Vertex AI data-governance practices. Google does not use customer data to train or fine-tune AI models without prior permission or instruction. Google states that its Gemini models may, by default, cache inputs, outputs, and derived data in project-isolated memory for up to 24 hours to improve service performance; Google may also log prompts for abuse monitoring. You can change these permissions at any time in your device’s Settings under Privacy & Security.

5. How we use information

We use the limited information we collect to:

Where the EU or UK General Data Protection Regulation applies, our legal bases for processing are performance of a contract (providing the App and your account), your consent (camera, photos, optional feedback, and Photogenik Club communications), and our legitimate interests (securing and improving the App).

6. Analytics and tracking

We use Google Firebase Analytics to understand how the App is used. Firebase Analytics collects and processes app events and identifiers, including a pseudonymous app-instance identifier. We associate that identifier with subscription and purchase events processed by RevenueCat so that RevenueCat can send server-side subscription lifecycle events to Google Analytics even when the App is not open. This allows us to measure subscription performance, including offer and paywall experiments, renewals, cancellations, billing issues, and expirations.

This is first-party analytics: the data is used by us to operate and improve the App. We do not use it for advertising, we do not combine it with third-party data to target advertising, and we do not share it with data brokers. Accordingly, the App does not engage in “tracking” as defined by Apple’s App Tracking Transparency framework, and does not request tracking permission. 7. Third-party services and disclosure

We do not sell your personal information and do not share it for advertising. We rely on the following service providers to operate the App:

These providers process information on our behalf under their own terms and privacy policies, including the Google Privacy Policy, the Firebase Privacy and Security information, the RevenueCat Privacy Policy, and the Apple Privacy Policy.

7.1 Apple subscription and App-usage inquiries

If Apple contacts us about a subscription, purchase, refund, suspected fraud, App Review matter, or technical or App-usage inquiry, or if you ask us to work with Apple on such an inquiry, we may provide Apple with only the limited information reasonably necessary to investigate and respond. This may include subscription status, product and transaction identifiers, App version, and relevant diagnostic or usage events.

We do not provide Apple with your photos, camera feed, face or depth data, angle profile, email address, or unrelated App activity for this purpose, unless you specifically ask us to, consent to it, or disclosure is required by law. We do not share this information with Apple for advertising.

We may also disclose information where required by law, to enforce our Terms of Use, or to protect the rights, safety, and property of our users or the public.

8. Retention and account deletion

We retain your account information for as long as your account is active. If you join the Photogenik Club, we retain your signup information until you unsubscribe or ask us to delete it. Information stored locally remains on your device until you delete it or remove the App. Photogenik erases its Best Shots uploaded-image buffers when the analysis request finishes; a photo-free ranking result may be cached for up to 15 minutes for request completion and duplicate-charge protection. Google may temporarily retain Best Shots inputs as described in Section 4.1 and its linked Vertex AI data-governance documentation.

You may delete your account at any time from within the App, which removes your account and associated profile data from our systems. You may also request deletion by emailing hello@photogenik.app. We will action verified requests within a reasonable time, subject to any legal obligation to retain certain records.

9. Your privacy rights

Depending on where you reside, you may have the right to access, correct, export, restrict, or delete your personal information, and to object to or withdraw consent for certain processing.

9.1 EEA and UK (GDPR)

You have the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with your local data protection authority.

9.2 California (CCPA/CPRA)

You have the right to know what personal information we collect, to request its deletion, and to correct it. We do not sell or share your personal information as those terms are defined under California law, and we do not offer financial incentives in exchange for it.

10. Children’s privacy

The App is not directed to children under 13 (or the minimum age of digital consent in your country, where higher), and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. Security

We use industry-standard safeguards, including the security infrastructure provided by Google Firebase, to protect information in transit and at rest, and we restrict account data so that it is accessible only to you. Information stored on your device is protected by iOS application sandboxing. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. International data transfers

The account, analytics, and Best Shots data we collect is processed on Google’s cloud infrastructure, which may be located in the United States and other countries. Best Shots currently uses Vertex AI’s global endpoint, so selected photo copies may be processed in any region in Google’s global pool. By using the App, you understand that your information may be transferred to and processed in countries whose data protection laws may differ from those of your country. Where required, we rely on appropriate safeguards for such transfers.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide a more prominent notice. Your continued use of the App after an update constitutes acceptance of the revised policy.
